What happened

  • Janssen voluntarily admitted that a first-line sales manager did not take the required ABPI representatives examination within one year of starting the role.
  • The employee moved into the sales management role in Autumn/September 2014, leading a team of sales representatives.
  • In June 2015, Janssen’s learning & development (L&D) team was asked whether the manager needed to complete the ABPI representatives exam and advised “No” based on the individual’s background (health professional, signatory training). This advice was incorrect.
  • In April 2016, prompted by a gap in training records on the learning management system (LMS), L&D re-questioned the position and escalated to the medical director, who confirmed the exam was required.
  • Janssen reported the matter to the PMCPA as a potential breach (treated as a complaint under Paragraph 5.6 of the Constitution and Procedure).
⚖️

Outcome

  • Breach found: Clause 16.3 (exam not taken within the first year as a representative).
  • Breach found: Clause 9.1 (failure to maintain high standards).
  • No appeal.
