What happened

  • Baxter Healthcare made a voluntary admission that one of its representatives had not taken the required representatives’ examinations within one year of commencing their role.
  • A review of Baxter’s training database identified that the representative had not taken all modules within the first year.
  • The HR administrator knew exams were scheduled before the one-year anniversary but was not informed they had not been sat, so an extension was not requested in time.
  • The representative sat and failed elective modules within the first year, but booked then postponed (and therefore did not sit) the compulsory modules within that year.
  • The representative was scheduled to take the exams around 16–17 months after starting but resigned before taking them.
  • Under Paragraph 5.6 of the Constitution and Procedure, the Director treated the voluntary admission as a complaint.
⚖️

Outcome

  • Breach ruled: Yes.
  • The Panel ruled Baxter in breach of Clause 16.3 because the representative did not take the appropriate examination within the first year of employment.
  • No appeal.
