What happened

  • Merz complained about two Ipsen leavepieces promoting Dysport (botulinum toxin type A) that discussed dose ratios versus other BoNT-A products (including Xeomin and Botox).
  • Leavepiece 1 (ref UK/DYS08687(1)) tabulated SPC dosing for Dysport, Botox and Xeomin and included a “Dose ratios” column (eg Dysport:Xeomin ratios by indication, including maximum-dose ratios such as 3.3:1 for cervical dystonia).
  • Leavepiece 2 (ref UK/DYS08686(1), dated January 2014) summarised a systematic review/meta-analysis conducted in February 2012 and stated on the front page that “no studies compared Dysport and Xeomin”.
  • Ipsen said the materials were part of a “Dispelling the Myth” campaign (launched April 2013) intended to counter tender-driven proposals for a blanket 4:1 switch ratio and to reinforce that toxin units are not interchangeable and that no single ratio can be applied across indications/health economies.
  • Merz alleged the SPC-based ratios were misleading indirect comparisons and that the systematic-review leavepiece was incomplete/out of date (not reflecting later evidence and a September 2014 updated review).
  • The Panel also considered the combined use of the two leavepieces, given the sales briefing suggested SPCs were the “only comparison and guidance” and that there were “no publications comparing Dysport and Xeomin” (which became out of date).

Outcome

  • No breach was ruled for Clauses 7.2, 7.3 and 7.4 in relation to the allegation that the SPC leavepiece compared registration studies per se.
  • Breach rulings were made because the SPC leavepiece appeared to present unequivocal, recommended dose ratios per indication based on indirect SPC comparisons (not head-to-head studies) and because maximum-dose information was presented simplistically without reflecting SPC nuance/safety context.
  • Breach rulings were made because the systematic-review leavepiece (January 2014) was not based on an up-to-date evaluation of all relevant data (it did not reflect the September 2014 meta-analysis and later Dysport:Xeomin evidence), making the presentation misleading.
  • The Panel considered the two leavepieces “inextricably linked” and applied its breach findings to their combined use.
