What happened

  • An anonymous, non-contactable consultant haematologist complained about a meeting with a Chugai representative promoting Granocyte (lenograstim).
  • Allegations included: the rep showed information about G-CSF use in healthy donors that was not relevant to a non-transplant district general hospital and wasted time.
  • The complainant alleged the rep implied that results in healthy donors could be extrapolated to neutropenic patients (who are typically unwell with cancer and post-chemotherapy/radiotherapy).
  • The complainant challenged a slide quoting the European Group for Blood and Marrow Transplants (EBMT), alleging it was presented as a stipulation rather than a recommendation.
  • The complainant also alleged the rep told a senior nurse that Granocyte commissioning/reimbursement came directly from the new NHS commissioning board (NHS England) rather than local CCGs, implying full reimbursement.
  • Chugai interviewed all ten Granocyte-promoting representatives, provided the Granocyte e-sales aid and briefing document, and stated no KPI/metric compelled “tick box” visits; e-sales aid tracking was said to be regional page-use analytics.
  • Chugai provided NHS England directly-purchased products list evidence (link and screenshot) indicating Granocyte was directly commissioned/reimbursed by NHS England.

  • No breach of the Code was ruled for all allegations.
  • The Panel found the complainant did not provide supporting material and, being non-contactable, could not be asked for further detail; the burden of proof was not met on the balance of probabilities.
  • The Panel considered the materials provided (e-sales aid and briefing document) did not support the alleged extrapolation claim or misleading implication about EBMT wording.
  • The Panel did not consider it unreasonable for secondary care haematologists to be informed about tertiary-unit use (mobilisation) given follow-on care may occur in district general hospitals.
  • The Panel did not consider it established that the representative gave inaccurate reimbursement information to the senior nurse, and found no evidence Chugai incorrectly briefed representatives on reimbursement.
