What happened

  • An anonymous, non-contactable clinician (with a CCG advisory role) complained about a meeting with two Merck Sharp & Dohme (MSD) representatives using a computer programme called MIRROR (an interactive database using NHS Health Episode Statistics data).
  • The complainant alleged MIRROR was used to discuss non-elective hospital admissions (coronary events and hypoglycaemia-related admissions) and then to imply MSD medicines could reduce those admissions.
  • Allegations included that Ezetrol (ezetimibe) was presented as stopping coronary events and Januvia (sitagliptin) as stopping hypoglycaemic events requiring hospital treatment—without outcome data.
  • MSD denied the allegations, stated MIRROR users were trained, and said it could not identify any such meeting in its CRM records. MSD provided screenshots and briefing/training materials but could not provide the full tool due to its interactive nature.
  • Panel (first instance) initially ruled multiple breaches relating to implied outcome benefits and off-label promotion, plus high standards and discredit.
  • Appeal: MSD argued the meeting likely did not occur as described and that the complaint lacked supporting evidence (eg, no generated report was provided). MSD also clarified that MIRROR was used by Area Access Leads (AALs), typically alone, and that a two-disease-area MIRROR session would be impractically long.

Outcome

  • Appeal Board: Not satisfied the alleged meeting took place (on the balance of probabilities). Therefore, it ruled no breaches in relation to the alleged product claims about Ezetrol and Januvia.
  • However, the Appeal Board upheld that the MIRROR tool briefing/launch materials were likely to encourage discussions linking products to MIRROR-generated data in a way that could lead to Code breaches.
