What happened

  • An anonymous, non-contactable complainant alleged a named Sanofi medical representative had visited a local hospital on multiple occasions and behaved rudely.
  • The complainant alleged that on 25 July 2013 the representative swore several times in front of staff and patients and behaved aggressively.
  • The PMCPA asked Sanofi to respond in relation to Clauses 2, 9.1 and 15.2 (Code year 2012).
  • Sanofi stated no-one of the exact name worked for the company in the UK; a similarly named representative had left Sanofi in March 2013.
  • Sanofi gathered internal evidence (field visit reports and a statement from the former line manager) and said there was nothing of concern in the representative’s recorded behaviours during employment; the representative had passed the ABPI Representatives Examination.
  • Sanofi checked its sales team call recording database and found no record of any Sanofi representative attending the hospital on 25 July 2013.
⚖️

Outcome

  • The Panel ruled that the complainant had not established the allegations on the balance of probabilities.
  • No breach of Clause 15.2 was ruled.
  • No breach of Clause 9.1 was ruled.
  • No breach of Clause 2 was ruled.
  • No breach of the Code overall.
