What happened

  • A former employee complained about Astellas’ promotional practices, alleging multiple serious breaches that allegedly brought the industry into disrepute and wasted NHS funds.
  • Allegations included: inducements/excessive payments to switch patients from generics to Astellas brands (including Flomaxtra), “blanket switches” prejudicing patient safety, and misleading/disguised promotional meetings presented as “NHS meetings” (use of NHS logos, “mandatory” attendance messaging, branded “goody bags”, and attendance certificates used as “access tools”).
  • Further allegation: pressure to encourage excessive prescribing of Zineryt 90ml (vs 30ml), causing waste due to limited shelf life.
  • Astellas denied the allegations and provided meeting materials and other documentation; the Panel noted the case largely came down to one person’s word against another and the complainant provided very little supporting evidence.
