What happened

  • An anonymous, uncontactable hospital doctor complained about a visit by a Lundbeck hospital representative.
  • The doctor alleged the Lundbeck representative was accompanied by a representative from another named company (a competitor).
  • The two representatives allegedly discussed their respective competitor products and asked the doctor to use whichever of the two.
  • The complainant said this was unprofessional and unethical and put him in an awkward position.
  • The complainant said the ABPI copy of his letter would name the accompanying representative, but it did not.
  • The PMCPA asked Lundbeck to respond in relation to Clauses 15.2 and 15.9 (Code year 2008).
  • Lundbeck investigated internally, spoke to the named representative and other staff in the area, and spoke to the named company.
  • Lundbeck’s representative categorically denied ever making a joint visit with a competitor representative; Lundbeck provided details of recent accompanied calls (with Lundbeck manager/colleagues only).
⚖️

Outcome

  • No breach of the Code was ruled.
  • No breach of Clauses 15.2 and 15.9 was ruled.
  • No appeal.
