What happened

  • Two Roche employees complained anonymously about (1) alleged conduct by colleagues at a European meeting and (2) call-rate expectations for representatives.
  • European meeting allegation: colleagues allegedly took customers to a bar late at night and bought illegal substances; doctors allegedly commented on this afterwards.
  • Call-rate allegation: Roche allegedly required representatives to see doctors more than three times a year; complainants alleged they had to see at least four doctors per day and that, across territories, this could mean seeing some doctors up to eight times a year; bonuses were allegedly lost if targets were not met.
  • Because the complaint was anonymous, the Panel could not contact the complainants to comment on Roche’s response before ruling.
